If you want to buy wine from us or use our web site you can only do so on these terms and conditions, and by registering on the web site you are agreeing to be bound by them. All orders are subject to acceptance by us and we will confirm such acceptance to you by on-line electronic means (the 'Confirmation'). We expressly reserve the right to refuse any order made by a customer with whom we have an ongoing dispute or from anyone we suspect of making purchases on our site by fraudulent means.
Although they are written in small print, we hope you will agree that they are designed to be fair to you and to us. We may change these from time to time by updating this posting.

Age restriction
You must be 18 or over to purchase wine in the UK. By placing an order you confirm that you are at least 18 years old. If you are buying a case of wine as a gift - the recipient must also be over 18 years old. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.
Delivery
There is no minimum order.
The current minimum and maximum delivery charge is £10.00 inc. VAT independent of the quantities to be delivered, i.e. from the first bottle up to a million cases as shown on the shop checkout page.
This charge applies for delivery within the UK mainland. We regret that this does not apply to Northern Ireland or the Highlands or any Islands or other British Dependent Territories for which we will email an exact Courier Cost on receipt of your order.
We aim to deliver your wine within 7 days of your order subject to stock availability. Delivery is between 9am and 5pm Monday to Friday. Unfortunately it is not possible to arrange individual delivery times.
Please note that the carrier on delivery of your order will require a signature. You or your representative should check that the cases delivered match your order and the items listed on the carriers note. Please also ensure that the cases are sealed and in good condition. Should there be a discrepancy between your order and what is being delivered then please make a note on your order page and the carrier's sheet and contact within 24.00hrs by phone, fax or e-mail Hand Picked Wines so that we may investigate and correct the error.
Although we can accept orders for delivery to both Private and Business addresses it is your responsibility to accept or arrange for the reception of the order. As is usual if the carrier finds that there is no one available at the delivery address to accept the order they will leave a notification form requesting that you call to arrange another delivery day. If the driver leaves a card because you are out, then this will count as an attempted delivery.
We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
Availability
All wines are subject to availability and can run out from time to time.
If your order is not available due to unforeseen circumstances such as surge of sales, we will inform you of the next availability or we may change some of the bottles. If the vintage year ordered is not available, the closest and most similar vintage year will be delivered.
Quality Guarantee
All of our wines have been personally tasted by us and selected for their quality.
Wine is a product of agriculture and is therefore perishable. Occasionally, wines can develop faults. Due to the nature of the corks, wine can be “corked” or tainted with a smell and taste, which ruins the taste and enjoyment of the wine.
When this happens, please accept our apologies.
We aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved. Prices and payment
All prices are as marked, quoted per bottle in pounds sterling. The prices include Value Added Tax at currently 17.5% and Excise and Duties, unless otherwise specified.
Any delivery charges are additional.
We accept payment by Switch, Maestro, Visa, MasterCard through PayPal.
If you prefer to pay by cheque, p lease make cheques payable to \"Otterden Limited\". When paying by cheque, your order will be despatched after receipt of your cheque.
We may have to alter prices, without notice, in the event of major currency fluctuations or changes in the rate of duty, VAT or other taxes and market conditions.
We retain ownership of any products ordered until we have received full payment for such products. However, risk in the products will pass to you upon delivery.
Our Refund Policy
You may cancel your order at any time and for any reason within 7 days of delivery of the products ordered. In this case you must notify us of your wish to cancel in writing and you must return the product(s) to us at your expense in their original wrapping, intact and accompanied by all accessories and documentation that were part of the delivery. We will refund any monies paid to us (less commission paid to PayPal) in respect of a cancelled order within 30 days of receiving your note of cancellation and the returned goods.
Our Liability and Disclaimer
Our liability in connection with any products purchased through our web site is strictly limited to the purchase price of such products. This does not exclude or limit in any way our liability for fraud or for death or personal injury caused by our negligence or any other liability to the extent that it may not be excluded or limited as a matter of law. As a rule, we cannot accept any liability for changes to or defects in the products that are due to the products' manufacturers. We further accept no liability for any indirect or consequential loss or damage or for any loss of data, profit, revenue or business, however caused, even if foreseeable. We accept no liability for any minor errors or omissions that can remain despite the precautions taken by us in the presentation of the products.
Security
If you are nervous about shopping on the web, don't be. We use secure servers with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally. It is your responsibility to protect your password from being disclosed to any third party. We know of no documented cases of credit card fraud using our shopping system over the Internet. All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. Data protection
We will not pass on your details to any other third party organisation.
By providing your details to Hand Picked Wines trading as Hand Picked Wines Limited on our web site, you consent us to maintain, record, hold and use the information you have given us. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998. We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery company. From time to time, we may send information about discounts, free stuff and personalised offers on wine and champagne unless you have told us not to do so by ticking the 'opt out' newsletter box on our registration page.
Governing Law and Jurisdiction
Contracts for the purchase of products through our web site will be governed by English law. Any dispute arising from or related to such contracts shall be subject to the non-exclusive jurisdiction of the English Courts.
